Terms of Service

1. Acceptance of Terms

By accessing or using the MT Concierge website at mtconcierge.vip, the MT Concierge mobile applications for iOS and Android, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

"MT Concierge", "we", "us", and "our" refer to MT Concierge and its affiliates. "You" and "your" refer to any individual or entity accessing or using the Platform.

2. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use the Platform. By registering, you represent and warrant that all information you provide is accurate, current, and complete, and that you will maintain its accuracy.

3. Account Registration & Security

To access member features you must have an account. Accounts are created by our team as part of the membership onboarding process. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use.

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent or abusive behaviour.

4. Membership Tiers & Benefits

MT Concierge offers bespoke membership packages tailored to each client, with varying levels of access to events, activities, and services. Specific benefits, pricing, billing periods, and availability are agreed individually and may be updated from time to time.

  • Membership benefits are personal to the member and may not be transferred, shared, or resold.
  • We reserve the right to modify tier benefits, pricing, or availability with reasonable notice. Existing pre-paid membership periods will be honoured at the originally agreed terms.
  • Access to certain events, activities, and services may be subject to minimum tier requirements, availability, and additional charges.

5. Bookings, Orders & Enquiries

5.1 Enquiries & Quotations

You may submit enquiries through the Platform regarding events, activities, or services. Our concierge team will respond with information or a formal quotation. Quotations are valid for the period stated and are subject to availability.

5.2 Booking Confirmation

A booking is confirmed only when you receive written confirmation from MT Concierge (via the Platform, email, or WhatsApp). Submitting a request or making a payment does not guarantee availability.

5.3 Pricing & Availability

All prices are displayed in the currency indicated on the listing. Prices are subject to change without notice until a booking is confirmed. Some items are "enquire only" and require a personalised quotation.

5.4 Third-Party Suppliers

Many events, activities, and services are provided by third-party suppliers. While we vet our partners carefully, MT Concierge acts as an intermediary and is not the direct provider. Third-party terms and conditions may also apply.

6. Payments

  • Payments are processed securely through Stripe. By making a payment you also agree to Stripe's Terms of Service.
  • You authorise us to charge the payment method provided for all applicable fees, including membership fees, booking charges, and any agreed additional costs.
  • All amounts are due at the time of booking unless otherwise agreed in a quotation.
  • You are responsible for any taxes, duties, or charges imposed by your jurisdiction in addition to the listed price.

7. Cancellations & Refunds

Cancellation and refund policies vary depending on the event, activity, or service and will be communicated at the time of booking.

  • Events: Cancellations must be requested in writing. Refund eligibility depends on the event organiser's policy and how far in advance the cancellation is made.
  • Services & activities: Cancellation terms are specified in the applicable quotation or booking confirmation.
  • Membership fees: Membership fees are non-refundable once the membership period has commenced, unless otherwise required by applicable law.
  • If MT Concierge or a supplier cancels a booking, you will receive a full refund or, where possible, an equivalent alternative.

8. User Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the Platform's infrastructure, security, or other users' experience.
  • Attempt to gain unauthorised access to any part of the Platform, other accounts, or connected systems.
  • Scrape, crawl, or use automated means to access Platform content without our prior written consent.
  • Share, resell, or transfer your membership or any bookings obtained through the Platform without our written approval.
  • Submit false, misleading, or fraudulent information or enquiries.

9. Intellectual Property

All content on the Platform, including text, graphics, logos, images, software, and design, is the property of MT Concierge or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.

The MT Concierge name, logo, and all related marks are trademarks of MT Concierge. Nothing in these Terms grants you any right to use them.

10. Mobile Applications

Our iOS and Android applications are subject to these Terms in addition to the terms of the applicable app store (Apple App Store or Google Play). You acknowledge and agree that:

  • These Terms are between you and MT Concierge, not with Apple Inc., Google LLC, or any other app store provider (each, an "App Store Provider"). MT Concierge, not the App Store Provider, is solely responsible for the app and its content.
  • You have been granted a non-exclusive, non-transferable licence to use the app on a device you own or control, in accordance with the usage rules set out in the applicable App Store Provider's terms of service.
  • The App Store Provider has no obligation to provide any maintenance or support services with respect to the app.
  • MT Concierge is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including but not limited to: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
  • In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, MT Concierge, not the App Store Provider, shall be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
  • The app may request permissions to access device features (location, notifications, biometric authentication). You can manage these through your device settings at any time.
  • Each App Store Provider, and its subsidiaries, are third-party beneficiaries of these Terms as they relate to your licence of the app, and each App Store Provider will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

11. Push Notifications & Communications

By using the Platform you consent to receive transactional communications (booking confirmations, order updates, enquiry responses) via email, in-app notifications, and, where you have opted in, WhatsApp or SMS. You may opt out of promotional communications at any time through your account settings or by contacting us.

12. Disclaimer of Warranties

The Platform and all content, services, and features are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any content or listings on the Platform.

13. Limitation of Liability

To the maximum extent permitted by applicable law, MT Concierge and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform.

Our total aggregate liability for any claims arising under these Terms shall not exceed the total fees you paid to MT Concierge in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless MT Concierge and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

15. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Any provisions that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) will continue to apply.

You may delete your account at any time through the mobile app (Profile > Delete Account) or by contacting us at info@mtconcierge.vip. Account deletion permanently removes your personal data, including your profile, enquiries, messages, and membership. Outstanding obligations (including unpaid bookings) survive account deletion.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 14 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE, unless otherwise required by applicable consumer protection laws in your jurisdiction.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MT Concierge regarding your use of the Platform and supersede all prior agreements and understandings.
